What Happens at the Trial?

Because most of the parties in Small Claims Court are not represented by lawyers, the rules are generally more relaxed. Nevertheless, you will not win your case if you are not prepared to present your case. You must have your witnesses in court, as well as any documents (originals are preferred) or photographs which will help you establish your claim. Be prepared to question your witnesses and to cross examine the defendant and his/her witnesses. You may make opening and closing statements to the judge. All decisions are made by the Judge since there is no jury. Treat the Judge with respect, and address the Judge as "Your Honor."

If the defendant fails to appear in court, the judge will usually decide the case in your favor. This is called a "default judgement".
