How Do You File Your Case?

Generally, you must file your case in person in the Small Claims Court where either the defendant is located or where the transaction or event which gave rise to your claim occurred.

In Philadelphia, go to Room 500 at 34 S. 11th Street, to file your "Statement of Claim". Outside of Philadelphia, you will have to go to your local District Justice Court whose address is in the blue pages of that county's telephone book.

Bring any supporting documentation (for example, written contracts or agreements, insurance policies, etc.) to attach to the Statement of Claim form. You must pay a filing fee, which varies depending on the amount of your claim and the number of defendants (if you win your case, the filing fee will be included in your award). Also, you must have the correct name and address of the defendant. If the defendant is a business, you need to know if it is a corporation, partnership or sole proprietorship. When the complaint is filed, you will receive a trial date, generally six to eight weeks from the filing date.
